Terms and Conditions

Effective Date: 1/1/24


These Terms and Conditions ("Terms", "Agreement") govern the services provided by MC Landscaping ("Company", "we", "us", or "our"). By engaging our services, you agree to comply with these Terms. Please read them carefully. If you do not agree with these Terms, do not use our services.


1. Services Provided

MC Landscaping provides lawn care services, including but not limited to mowing, trimming, edging, fertilizing, weed control, aeration, and other lawn maintenance services ("Services"). The specific services you request will be detailed in a separate service agreement or contract.


2. Service Area

We offer services throughout Central San Diego County and parts of East, North Central, and South San Diego County. In East County, we serve up to and including El Cajon; in North Central County, we cover areas south of and including La Jolla; and in South County, we provide service north of and including Chula Vista. Requests for service outside these areas may need approval, and we reserve the right to decline service beyond our standard zones.


3. Quotations and Estimates

All quotations and estimates provided are valid for [insert time period] from the date issued, unless otherwise specified. Quotations are based on the information provided at the time and are subject to change if additional work is required or conditions change.


4. Scheduling and Appointments

You are responsible for providing access to the property on scheduled service dates. Any restrictions or access issues must be communicated to us in advance.

In the event of inclement weather or other unforeseen circumstances, we reserve the right to reschedule services.

We will endeavor to complete services on the agreed-upon dates but cannot guarantee exact timing due to weather, workload, or other factors beyond our control.


5. Recurring Services


5.1 Recurring Service Plans

MC Landscaping offers recurring service plans, including weekly, bi-weekly, monthly, or seasonal lawn care services. By subscribing to a recurring service plan, you agree to the automatic scheduling of services based on the chosen frequency and agree to be billed accordingly.


5.2 Cancellation of Recurring Services

You may cancel your recurring service plan at any time by providing 7 days written notice before the next scheduled service. Failure to provide sufficient notice may result in a charge for the next scheduled service.

We reserve the right to cancel or suspend recurring services if payments are not received on time, if access to the property is restricted, or if these Terms are breached.


5.3 Adjustments to Recurring Services

You may request changes to your recurring service plan (e.g., adjusting the frequency or scope of services) by contacting us at least 7 days in advance of the next scheduled service. We will confirm the changes in writing.

We may adjust the price of recurring services at any time with prior notice. If you do not agree to the price adjustment, you may cancel your recurring services as described above.


5.4 Pausing or Resuming Recurring Services

If you need to temporarily pause your recurring services (e.g., due to vacation or special circumstances), please notify us in writing at least 7 days prior to the next scheduled service. We will accommodate reasonable requests to pause services for up to [insert time frame].

If you wish to resume paused services, please provide written notice at least 7 days prior to your desired resumption date.


6. Cancellation and Rescheduling

Cancellations must be made at least 48 hours in advance of the scheduled service. Cancellations made less than 48 hours prior to service may incur a cancellation fee.

We reserve the right to cancel or reschedule appointments due to weather, safety concerns, or other unforeseen circumstances.


7. Pricing and Payments

The cost of services will be specified in a separate service agreement or invoice. Prices are subject to change with prior notice.

Payments are due upon receipt of the invoice or in accordance with the terms specified in the service agreement. Late payments may incur a late fee of 5%.

We accept [list accepted payment methods, e.g., credit cards, checks, electronic payments].

If payment is not received within 15 days, we reserve the right to suspend or terminate services until the outstanding balance is paid.


8. Customer Responsibilities

To ensure we provide the best possible service, you agree to:


Ensure your lawn is free of obstacles such as toys, furniture, or debris prior to our arrival.

Allow us reasonable access to the property during the scheduled service times.

Provide accurate and up-to-date contact information for communication purposes.


9. Use of Chemicals and Fertilizers

We may use commercial-grade products, including but not limited to fertilizers, weed control products, and other lawn care treatments, depending on the specific needs of your lawn. By engaging our services, you acknowledge that the use of such products is at our discretion based on our professional judgment.

If you have any sensitivities, allergies, or concerns regarding the potential use of chemicals or fertilizers on your lawn, it is your responsibility to inform us prior to the commencement of services.

In cases where such products are used, you are responsible for ensuring that pets, children, and others avoid treated areas for the recommended period following application, as specified by product guidelines.


10. Damage and Liability

While we take care to avoid damaging your property, MC Landscaping is not liable for damage to underground utilities, sprinkler systems, or other objects not clearly visible or marked on the property.

We are not responsible for any damage resulting from poor lawn conditions, pre-existing issues, or improper care outside of our service.

In the unlikely event that damage occurs due to our negligence, you must report it to us within 3 days of the service date, and we will work with you to resolve the issue.


11. Termination of Services

Either party may terminate the service agreement at any time by providing written notice at least 7 days before the next scheduled service.

We reserve the right to terminate services if you breach these Terms, including failure to make payments or providing us with inaccurate information.


12. Disclaimers and Limitation of Liability

Our services are provided on an "as-is" and "as-available" basis. We make no guarantees regarding the long-term condition of your lawn or garden following our services, as results may vary based on weather, soil, and other environmental factors.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of fitness for a particular purpose.

In no event will MC Landscaping be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our services.


13. Governing Law

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].


14. Amendments

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website or providing written notice to you. Continued use of our services after such changes constitutes your acceptance of the new Terms.
